SpeedUp US Inc (“we”, “our”, “us” or “SpeedUp”) may collect Delivery Drivers’ (“Drivers” or “Driver”) personal information when Drivers submit a Driver application at SpeedUp, use our mobile application or our other online platforms (together referred to as “Our Platforms”), or when otherwise interacting with SpeedUp as a Driver.

SpeedUp is dedicated to protecting your privacy and this Privacy Policy explains our approach to the handling and protection of SpeedUp Drivers’ personal information.

This Privacy Policy applies to all Driver applicants, registered Drivers and their substitutes. However, terms in this Privacy Policy regarding personal information provided during the application and on-boarding phase do not apply to substitutes. Please read this Privacy Policy with great attention. If you are a registered Driver and you use substitutes to provide services on your behalf, you are also responsible for making sure that your substitutes have read and understood this Privacy Policy before they begin delivering food with SpeedUp.

By accessing or using Our Platforms or otherwise sharing your personal information with us, you accept that your personal information is collected, shared and otherwise handled in accordance with the terms of this Privacy Policy. If you do not consent to all of the terms of this policy, please do not use Our Platforms or otherwise provide your personal information to us.



1. PERSONAL INFORMATION WE COLLECT

We collect your information on several occasions, such as when you apply to be a Driver at SpeedUp and when you access Our Platforms. Here are more details about how your information is collected: 

1.1. Data Provided Directly By You

● Account setup and application process: When you make an application to become a Driver at SpeedUp, we ask you to provide information such as your name, contact information, date of birth, postcode, preferred location to work, vehicle type, work equipment, emergency contacts, bank account information, right to work, and whether you have any unspent criminal convictions. In order to complete the application process, SpeedUp (or a third party) also ask that you provide a copy of your government identification and proof of address so we can conduct a criminal background check and verify your right to work. Depending on the type of vehicle you use, we may also require you to provide a copy of your license, your insurance information, and the vehicle registration details.

● Personal Image and Facial Data: To maintain platform security, verify your identity, prevent fraud, and display your profile photo within the SpeedUp platform, we may collect portrait photographs (selfies) that you voluntarily provide during registration, identity verification, or account management processes. We collect only standard two-dimensional (2D) images. We do not use ARKit, TrueDepth APIs, or other biometric technologies to create facial maps, facial recognition templates, facial geometry data, or other biometric identifiers. Profile photographs are used solely for identity verification, trust and safety purposes, and profile display within our services.

● Retention of Face Data: Your face data (portrait photographs) will be retained only for as long as reasonably necessary to provide identity verification and profile-related services during your active relationship with SpeedUp. If your account is deactivated, terminated, or remains inactive for an extended period, your face data will be securely deleted within a reasonable period unless a longer retention period is required for legal obligations, fraud prevention, dispute resolution, security investigations, or regulatory compliance purposes.

● Sharing and Storage of Face Data: We do not sell, rent, or disclose face data to advertisers or unrelated third parties. Face data is stored securely within SpeedUp’s own systems and databases and is used solely for the purposes described in this Privacy Policy. We do not provide face data to third-party facial recognition services, advertising platforms, or external biometric processing providers.

● Other information you provide: We may collect and store other information you provide about yourself during your communications or interactions with SpeedUp (e.g. when you speak with members of our support staff).



1.2. Personal Information Automatically Collected

● Delivery services: We record information about your delivery services including the orders you accept or reject, the dates and times you accept deliveries, the dates and times of order pick-ups, the dates and times of delivery completions, the amount of time taken to complete the orders, payment details for each order, and any feedback we receive about your services on Our Platforms.

● Participation: We collect and store information of your booked working time slots and your participation during those time slots.

● Location: When Our Platforms are running either in the foreground or background of your device, we may collect the precise location of your device. When you request to use a location-based function in Our Platforms, we access your location from your device in order to provide this functionality.

● Device data: We collect technical information from your mobile device or computer, such as its operating system, the device and connection type, and the IP address from which you are accessing Our Platforms.



2. COOKIES AND TECHNOLOGIES

Our Platforms use cookies and similar technologies to distinguish you from other users. This helps us to provide you with a good experience when you use Our Platforms and also allows us to improve Our Platforms.

Most web browsers automatically accept cookies and similar technologies, but if you prefer, you can change your browser to prevent it from automatically accepting cookies and your help screen or manual will tell you how to do this. We also give you information about how to disable cookies. However, you may not be able to take full advantage of Our Platforms if you disable cookies.

● A number of cookies and similar technologies we use last only for the duration of your app session and expire once you exit Our Platforms. Others are used to remember you when you return to Our Platforms and will last longer.

● We use these cookies and other technologies on the basis that they are necessary for the performance of a contract with you, or because using them is in our legitimate interests (where we have determined that these interests are not overridden by your rights), and, in some cases, where required by law and where you have consented to their use.



3. HOW & WHY WE USE YOUR INFORMATION

We will only process the data we collect about you if there is a reason for doing so, and if that reason is permitted under applicable data protection law. We will have a lawful basis for processing your information under the following circumstances:

a) if we need to process your information for the performance of a contract with you or to enter into a contract;

b) we have your consent;

c) we have a justifiable reason, which is in our legitimate interests, for processing your data; or

d) we are under a legal obligation to do so.

3.1. Where we need to process your information for the performance of a contract with you, or at your request before we enter into a contract, we use your information for the following reasons:

● to provide and manage your Driver application, account, and on-boarding process, including to execute your Independent Contractor Agreement;

● to provide you with access to and use of Our Platforms;

● to communicate with you about your services to SpeedUp, any important changes or developments to Our Platforms, and about the working time slots you booked;

● to enable SpeedUp’s support staff to communicate with you to support your services;

● to compensate you for your delivery services and offer you order-specific delivery fees (if applicable).

3.2. We may process your data with your consent (or, in certain circumstances, in our legitimate interests) to send you emails about SpeedUp’s products and services, and/or any promotions from third parties which are designed to support your provision of services to SpeedUp. You always have the option to unsubscribe from these emails.

3.3. We also process your data where we have a justifiable reason for doing so. We have listed these reasons below:

● to improve the effectiveness and quality of service that our drivers can expect from us in the future;

● to tailor opportunities that we share with you so you can make more money in connection with your delivery services, such as by booking certain working time slots or by referring your contacts to become Drivers at SpeedUp;

● to enable our support staff to help you with any inquiries, complaints, or incidents in the most efficient way possible;

● to contact you for your views and feedback regarding Our Platforms and to notify you if there are any important changes or developments to Our Platforms;

● to provide our customers and Restaurant Partners with SpeedUp services and a positive experience by providing live order progress updates using your order progress swipes on Our Platforms;

● to analyze your activity on Our Platforms so that we can administer, support, improve, and develop our business, for statistical and analytical purposes, and to help us prevent fraud; and

● to enforce our contractual terms with you and any other agreements, for the exercise or defense of legal claims, and to protect the rights of SpeedUp, its Restaurant Partners, customers, and others.



4. OUR PROMOTIONAL UPDATES AND COMMUNICATIONS

Where permitted in our legitimate interest or with your prior consent and where required by law, we will use your personal information for marketing analysis and to provide you with promotional communications about our products or services.

You can object to further marketing at any time by checking and updating the contact details in your account, or by selecting the “unsubscribe” link at the end of all our marketing and promotional communications.



5. RETENTION OF YOUR INFORMATION

We will not retain your information for a longer period of time than we think is necessary. Information that we collect will be retained for as long as needed to fulfill the purposes outlined in the “How & Why We Use Your Information” section above, in line with our legitimate interest or for a period specifically required by applicable regulations or laws, such as retaining the information for regulatory reporting purposes.

When determining the relevant retention periods, we will consider the following factors:

● our contractual obligations and rights in relation to the information involved;

● legal obligation(s) under applicable law to retain data for a certain period of time;

● statute of limitations under applicable law(s);

● our legitimate interests where we have carried out balancing tests (see section on “How & Why We Use Your Personal Information”);

● actual or potential disputes;

● the establishment, exercise or defense of any actual or potential legal claim; and

● guidelines issued by relevant data protection authorities.

We securely erase your information where we no longer require your information for the purposes collected.



6. DISCLOSURE OF YOUR INFORMATION

We are very careful and transparent about who else your information is shared with.

6.1. Sharing Your Information Internally

We share your information with other SpeedUp group companies only where necessary for the purposes set out in section 3.

6.2. Sharing Your Information With Third Parties

To promote the safety and quality of Our Platforms, we may share your contact number, vehicle type and location with customers and food providers. To facilitate our ordinary business operations, we may also share your information with third parties who provide services to us, including third parties that provide payment and direct deposit processing, background and driving record checks, web analytics, data processing, IT services, customer support providers, and other service providers. We may also disclose aggregate, anonymous information to these third party service providers.

SpeedUp will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy when it is transferred to third parties.

6.3. Business Transaction

If our business enters into a joint venture with, purchases or is sold to, or merged with another business entity, your information may be disclosed or transferred to the target company, our new business partners, owners or their advisors.

6.4. Legal Obligations and Rights

We may also share your information in the following circumstances:

● if we are under a duty to disclose or share your information in order to comply with any legal obligation or regulatory requirement. This includes exchanging information with other companies and other organizations for the purposes of fraud protection and prevention;

● in order to enforce our contractual terms with you and any other agreement;

● to protect the rights of SpeedUp, Restaurant Partners, users, or others, including to prevent fraud.



7. WHERE WE STORE YOUR DATA & INTERNATIONAL DATA TRANSFERS

We will take all steps reasonably necessary to ensure that your data is subject to appropriate safeguards, such as relying on a recognized legal adequacy mechanism, and that it is treated securely and in accordance with this Privacy Policy.

We may transfer your personal information for the following reasons:

● to store it;

● to enable us to provide goods or services and fulfil our contract with you or the company you work for. This includes order fulfilment, processing of payment details, and the provision of support services;

● where we are legally required to do so;

● as part of normal application operation and processing; and

● to facilitate the operation of our group of businesses, where it is in our legitimate interests and where we have concluded these are not overridden by your rights.



8. SECURITY

● We adopt robust technologies and policies to ensure the personal information we hold about you is suitably protected. Any payment transactions will be encrypted using Secure Sockets Layer (“SSL”) technology.

● We take steps to protect your information from unauthorized access and against unlawful processing, accidental loss, destruction and damage.

● Where you have chosen a password that allows you to access certain parts of the sites, you are responsible for keeping this password confidential. We advise you not to share your password with anyone.

● Unfortunately, the transmission of information via the internet is not completely secure. Although we will take steps to protect your information, we cannot guarantee the security of your data transmitted to the sites; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.



9. YOUR RIGHTS

Under data protection law, you may in certain circumstances have a number of rights concerning your personal data. ● The right to be informed. You have the right to be provided with clear, transparent and easily understandable information about how we use your information and your rights. This is why we’re providing you with the information in this Privacy Policy.

● The right of access. You have the right to obtain access to your information (if we’re processing it). This will enable you, for example, to check that we’re using your information in accordance with data protection law. If you wish to access the information we hold about you in this way, please contact our Data Protection Officer (see Contact Details).

● The right to rectification. You are entitled to have your information corrected if it is inaccurate or incomplete. You can request that we rectify any errors in information that we hold by contacting us (see Contact Details).

● The right to erasure. This is also known as “the right to be forgotten” and, in simple terms, enables you to request the deletion or removal of certain information that we hold about you by contacting us (see Contact Details). You may request to update, replace, or delete your portrait photographs used for identity verification and profile display at any time. Deactivation of your account will result in deletion of such photographs in accordance with our data retention policy.

● The right to restrict processing. You have the right to “block” or “suppress” further use of your information. When processing is restricted, we can still store your information, but will not use it further.

● The right to data portability. You have the right to obtain your personal information in an accessible and transferrable format so that you can re-use it for your own purposes across different service providers. ● The right to lodge a complaint. You have the right to lodge a complaint about the way we handle or process your information with the national data protection authority.

● The right to withdraw consent. If you have given your consent to anything we do with your information (i.e. we rely on consent as a legal basis for processing your information), you have the right to withdraw that consent at any time. You can do this by contacting us (see Contact Details). Withdrawing consent will not however make unlawful our use of your information while consent has been apparent.

● The right to object to processing. You have the right to object to certain types of processing, including processing for direct marketing and profiling. You can object by changing your marketing preferences or disabling cookies as set out above.



10. UPDATES

We may amend the terms of this Privacy Policy occasionally and we recommend that you check the contents on this webpage from time to time. If we make a change to the Privacy Policy, we will provide the most updated version on Our Platforms. If any of the updates we make are material, we will also notify you by email using the email address you have provided to us. If you disagree with any of the changes we make, you must stop using Our Platforms immediately. Your continued access to Our Platforms means you agree to the most updated version of this Privacy Policy.
